    WellCheck ("WC," "we," "us," or "our") provides a business-to-business automated communications platform. This Privacy Policy explains how we collect, use, disclose, and safeguard information in connection with our services.

    WC is a technology platform. We are not a healthcare provider, emergency service, financial institution, or data broker.

    1. Scope of This Policy

    This Policy applies to:

    • Information collected from Customers (businesses) who access or use WC services
    • Information about recipients of automated calls placed through the WC platform
    • Visitors to WC websites and related digital properties

    This Policy does not apply to third-party services or platforms linked from WC properties.

    2. Information We Collect

    A. Account & Customer Information

    When a Customer registers for or uses WC services, we may collect:

    • Business name and contact information
    • Billing and payment information
    • Account credentials
    • Communications with WC support

    B. Campaign & Call Data

    When Customers create and run campaigns, we collect:

    • Contact lists uploaded by Customers
    • Campaign configuration settings
    • Call records, timestamps, and outcomes
    • Transcripts of calls made through the platform
    • Survey responses collected via automated calls

    C. Usage & Technical Data

    We automatically collect certain technical information when you use the platform, including:

    • IP addresses and device information
    • Browser type and version
    • Pages visited and features used
    • Timestamps and session durations

    D. Recipient Data

    Customers upload contact information for call recipients. WC processes this data on behalf of Customers. Recipient data may include name, phone number, and other contact details provided by the Customer.

    E. SMS/Text Message Data

    When a recipient verbally consents during a call to receive SMS updates (such as an appointment confirmation or reminder), we collect the recipient's phone number, the content and timing of messages sent, and delivery and opt-out status.

    3. Information We Do Not Intentionally Collect

    WC does not intentionally collect sensitive personal information such as Social Security numbers, government identification numbers, financial account numbers, health or medical data, or biometric data.

    WC does not perform voice biometric processing, speaker identification, or voiceprint generation of any kind. WC's call transcription is limited to converting speech to text for conversational purposes and does not create any biometric identifier or voice-matching template.

    WC is not a healthcare provider. The platform is not intended for protected health information (PHI) as defined by HIPAA, and WC does not act as a business associate or enter into Business Associate Agreements. Customers are responsible for determining whether their use of the platform implicates HIPAA or comparable health-privacy laws, and for configuring call scripts and uploaded contact data so that PHI is not submitted to WC. Customers should be aware that WC retains call transcripts, as described in the retention section below.

    4. How We Use Information

    WC uses collected information to:

    • Provide, operate, and maintain the WC platform
    • Process and fulfill service transactions
    • Send administrative and operational communications
    • Send SMS confirmations and reminders a recipient has consented to receive
    • Monitor and analyze platform usage and performance
    • Detect, investigate, and prevent fraud or misuse
    • Comply with legal obligations
    • Enforce these Terms and our agreements

    5. Legal Basis & Responsibility

    WC acts as a data processor for Customer-uploaded contact data and as a data controller for its own business data.

    Customers are responsible for obtaining all legally required consents from recipients before uploading contact information to WC.

    WC processes recipient data pursuant to Customer instructions and does not use recipient data for WC's own marketing or commercial purposes.

    Customers bear full responsibility for compliance with applicable privacy and communications laws, including the TCPA, CCPA, and any other applicable regulations.

    6. Sharing of Information

    A. Service Providers

    WC may share information with third-party vendors and service providers that perform services on our behalf, such as telecommunications carriers, cloud hosting providers, payment processors, and analytics services.

    These parties are contractually obligated to use the information only for the purposes for which it was disclosed.

    B. Legal Requirements

    WC may disclose information when required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of WC, its customers, or others.

    C. Business Transfers

    In the event of a merger, acquisition, or sale of all or a portion of WC's assets, Customer and platform data may be transferred to the acquiring entity, subject to the terms of this Policy.

    D. AI/ML Service Providers

    WC uses OpenAI's API platform to power its AI phone agent and to generate campaign scripts, summaries, and suggested text, and uses Deepgram and Cartesia for speech-to-text and text-to-speech processing during calls. These providers process data solely to deliver the requested service and, under their standard commercial API terms, do not use data submitted through their APIs to train or improve their underlying models.

    Where a Customer connects a Google Calendar (an optional, Customer-initiated integration), WC retrieves only free/busy time windows from Google's Calendar API — never event titles, descriptions, attendees, or other calendar content — solely to compute available appointment times. Only these computed time windows, not any raw or aggregated Google Calendar data, are ever provided to WC's AI phone agent so it can offer and confirm appointment times during a call.

    Limited Use Compliance Statement: WellCheck's use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. Data obtained through Google Calendar integration is never used to create, train, or improve any AI/ML model, whether raw, aggregated, or derived.

    7. Data Security

    WC implements commercially reasonable technical and organizational measures to protect information against unauthorized access, alteration, disclosure, or destruction.

    No method of electronic transmission or storage is completely secure. WC cannot guarantee absolute security of information.

    In the event of a data breach affecting Customer data, WC will notify affected Customers in accordance with applicable law.

    8. Data Retention

    WC retains Customer account information for the duration of the Customer's account and for a reasonable period thereafter as required by law or legitimate business purposes.

    Call transcripts and logs are retained for a period determined by WC's internal data retention schedule.

    Customer-uploaded contact data may be deleted upon written request, subject to applicable legal hold requirements.

    Credits, transaction records, and billing information may be retained as required by applicable tax and financial regulations.

    9. Recipient Rights

    Individuals who have received automated calls via the WC platform may contact the Customer who initiated the call for information about how their data is used.

    WC will respond to verified requests within the timeframes required by applicable law.

    10. California Privacy Rights (CCPA)

    If you are a California resident, the California Consumer Privacy Act (CCPA) may provide you with certain rights regarding your personal information.

    Right to Know: You have the right to request that WC disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which personal information was collected, the business or commercial purposes for collecting personal information, and the categories of third parties with whom we share personal information.

    Right to Deletion: You have the right to request that WC delete personal information we have collected from you, subject to certain exceptions permitted by law.

    Right to Non-Discrimination: WC will not discriminate against you for exercising any of your CCPA rights.

    To submit a CCPA request, please contact us at privacy@wellcheck.app. We will verify your identity before processing your request.

    WC does not sell personal information as defined under the CCPA.

    Note: WC's primary relationships are with business Customers. Consumer-facing CCPA rights may be limited in the B2B context.

    11. Geographic Limitation

    WC services are designed for use within the United States. WC does not intentionally collect data from individuals outside the United States.

    If you access WC services from outside the United States, you do so at your own risk and acknowledge that your information may be transferred to, stored, and processed in the United States.

    12. Children

    WC services are intended solely for business use by adults. WC does not knowingly collect personal information from individuals under the age of 18.

    If WC becomes aware that personal information of a minor has been submitted, WC will take steps to delete such information promptly.

    13. Cookies & Tracking

    WC uses cookies and similar tracking technologies to operate and improve the platform, analyze usage, and maintain security.

    Essential cookies are required for platform functionality. Analytics and preference cookies may be controlled through your browser settings.

    WC does not use tracking technologies for behavioral advertising.

    14. Changes to This Policy

    WC may update this Privacy Policy from time to time. WC will notify Customers of material changes via email or prominent notice on the platform prior to the changes taking effect.

    Your continued use of the platform after changes are posted constitutes your acceptance of the revised Policy.

    The date of the most recent revision is indicated at the top of this Policy.
